Aer Lingus and Ryanair Statutory Compensation for delayed Flights.
I was recently delayed on a flight from Malaga to Dublin by 7hrs 15min by Ryanair ,I decided to see what is the position with compensation.
The regulation covering compensation is summarized below:
Regulation (EC) No 261/2004
Within the EU, there are rules and laws that determine how airlines can and cannot treat passengers. When you buy an air ticket, you agree to the airline's terms and conditions. This does not, however, mean that the airline can treat you how they want to, as long as it's featured in their terms and conditions. They also have to follow guidelines. This applies to European airlines, but also to non-European airlines that want to do busines or fly to or from Europe.
In order to ensure that air passengers were sufficiently protected, the European Parliament and European Commission set up Regulation (EC) no. 261/2004. This document establishes rules about the criteria and conditions for flight cancellation and denied boarding. Five years later, in 2009, it was determined that these rules shouln't just apply to cancelled flights and cases of denied boarding, but also to flight delays. That means all air passengers who experience delays in Europe qualify for care and in many cases also compensation.
The level of compensation is between €400 and €600 depending on distance of flight.
The EU regulation as clarified by EU court in case against KLM is that if flight is delayed by mechanical or electrical fault for more than 3 hrs you are entitled to compensation, as well as flight. Sustinance may be provided after 1-2 hr.(varies).
Aer Lingus state on their web site ,when you eventually find it, that they will pay compensation into your account automatically after 7days.

However having tried on 5 occasions to get compensation, and finally declaring my intention to go to EU court with correspondence No.5, I already had the backing of Irish CAA, I got notificatiion by return that I would be compensated within 2 weeks with €400 and an apology for the delay, but not for the hassle I went through in trying to seek what was due in law.
